Terms of Service
Placeholder. This document is a structural scaffold. Replace the content below with legally-reviewed copy before launch.
1. Agreement
These terms govern your use of the RaceDash desktop application and the RaceDash website at racedash.io (together, the Service). By using the Service you agree to these terms.
2. Your account
You must be 18 or over to create an account. If you're 13 to 17, you can use RaceDash only with the permission of a parent or guardian, who agrees to these terms on your behalf. RaceDash is not for children under 13.
You need an account to use RaceDash. You're responsible for keeping your account credentials secure. If you think your account has been compromised, let us know at security@racedash.io.
3. Subscription and billing
RaceDash is sold as an annual subscription. Prices are shown in GBP on our pricing page. Subscriptions renew automatically unless cancelled.
- Cancel any time from your account page. You keep access until the end of the period you've paid for, and your subscription won't renew.
- Changing your mind. When you first subscribe, the law normally gives you 14 days to cancel. RaceDash is digital content you can download and use straight away. So we ask you to confirm two things: that you want access now, and that you understand you lose this 14-day right once the download starts. We ask at checkout, or before your first download if you didn't confirm at checkout, and we email you a confirmation when you do. If you didn't give that confirmation, you can cancel within 14 days of subscribing and get a full refund.
- If you cancel partway through a subscription period, we don't refund the time you haven't used. This doesn't affect your rights if RaceDash is faulty (see section 7).
4. Licence
When you subscribe, we grant you a limited, non-exclusive, non-transferable licence to use the RaceDash desktop app on your own machines. You may not:
- Sublicence, resell or redistribute the software
- Reverse-engineer the software
- Use the service to process content you don't have the rights to
5. Your content
You keep all rights to the footage, timing data and other content you bring into RaceDash. We need a limited licence to process that content on your behalf (e.g. to render it into video), but we never claim ownership.
6. Availability
We aim for high availability but we don't promise 100% uptime. Scheduled maintenance and incidents can affect the service. Where an outage is within our control, we'll communicate it via status.racedash.io.
7. Our responsibility to you
- If RaceDash is faulty. The law says RaceDash must be of satisfactory quality, fit for purpose and as described. If it isn't, you can ask us to repair or replace it. If we can't, or we don't fix it within a reasonable time and without significant inconvenience to you, you may be entitled to a price reduction. That can be up to a full refund.
- If RaceDash damages your device or other content. If RaceDash damages a device or digital content that belongs to you because we didn't use reasonable care and skill, we'll repair the damage or compensate you. We aren't responsible for damage you could have avoided by installing a free update we told you about, or caused by running RaceDash below the minimum system requirements we published before you subscribed.
- Loss we're responsible for. We're responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or not using reasonable care and skill. Loss is foreseeable if it was obvious it would happen, or if you and we both knew it might happen when you subscribed. We aren't responsible for loss that isn't foreseeable.
- Business use. RaceDash is for personal use. If you use it for business, we aren't liable to you for loss of profit, loss of business, business interruption or loss of business opportunity.
- What we never limit. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law doesn't allow us to limit.

8. Changes
We may update these terms from time to time. Material changes will be emailed to account holders.
9. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.
